Chief Justice Yahya Afridi issued the four-page judgment and clarified that authorities must distribute pension benefits in line with the relevant laws and the service rules of the concerned institution.
The court ruled that only the widow or a person legally nominated under the applicable rules can receive pension payments. It added that brothers and sisters cannot claim pension benefits solely because they are legal heirs.
Furthermore, the judgment stated that authorities must follow the governing legal framework and institutional regulations when disbursing pensions.
The Supreme Court dismissed an appeal filed by the siblings of a deceased PESCO employee, who had sought the issuance of a succession certificate to claim the pension benefits.
As a result, the apex court upheld the earlier judgment of the Peshawar High Court, reinforcing that pension payments must comply with applicable service rules rather than general inheritance claims.
